Terms of Service

1. Purpose

These Terms set out the conditions for using the mobile game Neon Rush: Millisecond Beats (the "Game") provided by TERAGAMEZ ("we", "us"), and the rights and obligations of us and our users.

2. Effect and changes

1. These Terms apply to everyone who installs and uses the Game.
2. We may change these Terms within the limits of applicable law. Changes are posted on this page 7 days before they take effect (30 days for changes unfavourable to users).
3. If you do not agree to a change, you may stop using the Game and uninstall it. Continuing to use the Game after the effective date means you accept the change.

3. No account — your data stays on your device

1. You can use every feature of the Game without signing up or signing in.
2. All progress — your nickname, records, Points, unlocked songs and settings — is stored only on your device. We keep no copy on our servers.
3. We cannot restore data lost by uninstalling the app, or by resetting, losing or replacing your device. The Game does not offer a way to move progress to another device.

4. The service

1. The Game is free to download and has no ads and no in-app purchases.
2. The built-in songs play without an internet connection. Viewing the store song list and downloading songs require one.
3. We may change the Game through updates (rules, difficulty, rewards, charts and so on) for operational or technical reasons. Store songs may be added or updated, and may be removed from the store for reasons such as rights clearance. Songs already downloaded to your device remain playable unless you uninstall the app.
4. If we stop providing the Game or the song server, we will announce it at least 30 days in advance on the store listing or this website.

5. Points and store songs

1. Points are an in-game currency earned by playing. You receive welcome Points on first launch, and you earn Points by clearing a song or getting far enough into one, depending on difficulty and grade. Earning rules may change in updates.
2. You can unlock store songs with Points. Each song's price is shown in the store before you unlock it.
3. Points cannot be bought with money, have no cash value, and cannot be exchanged for money or anything else or transferred to anyone.
4. Your Points and the record of which songs you own are stored on your device. If a song download fails, you can download it again without spending Points again. Uninstalling the app deletes your Points and ownership records, and they cannot be restored.
5. Resetting records in Settings (RESET ALL RECORDS) does not erase your Points or downloaded songs.

6. Paid purchases

The Game currently has no paid purchases. If we introduce paid items in the future, we will add payment, cancellation and refund terms here and give notice as described in section 2.

7. Prohibited conduct

You must not:

• tamper with game files or save data to obtain records, Points or songs by illegitimate means;
• access the song server by abnormal means, or bulk-download song files to redistribute them;
• reverse-engineer, copy, modify or redistribute the Game, or infringe the intellectual property of us or of music rights holders;
• do anything else that breaks the law.

8. Intellectual property

1. We own the rights to the Game's software, artwork, charts and text.
2. The music in the built-in and store songs belongs to us or to its rightful owners. You may use it only to play within the Game. You may not extract or record it from the Game to distribute it or use it commercially.

9. Deleting your data

As there is no account, there is no separate account-deletion process. Uninstalling the app deletes all game data. 

10. Limitation of liability

1. We are not liable for interruptions that occur without our intent or negligence, such as outages of carriers, app stores or cloud services.
2. We are not liable for loss of data on your device caused by reasons attributable to you, such as uninstalling the app or losing or replacing your device.
3. Judgement results can be affected by your device's audio latency. The Game provides SYNC CALIBRATION to reduce this.
4. To the extent permitted by law, we are not liable for damages relating to this free Game unless caused by our intent or gross negligence.

11. Governing law and disputes

These Terms are governed by the laws of the Republic of Korea. We will first try to resolve any dispute through support; if that fails, it will be settled by the competent court under the Korean Civil Procedure Act. Where the consumer protection laws of your country of residence give you stronger protection, those laws prevail.
